1. Scope
These AGB apply exclusively to all contracts concluded over the Internet or by other methods of electronic commerce. The customer particularly accepts this AGB at order from our Internet Shop or giving of a commandment at internet-auctions. We only appreciate conditions of the customer standing contrary or differing from the AGB when we particularly agree to the validity in writing.

2. Right of return
If you are a customer consumer according to § 13 of German BGB under the terms of the Fernabsatzgesetz (= remote sales act), you may return to us goods delivered by us to you within two weeks without detail of reasons. The period starts with receipt of the goods and this instruction at the earliest. For the preservation of the period the timely despatch of the goods suffices. In every case the return is carried out at our expense and risk.

The return has to be in a faultless condition including all original packing parts and in an insured package postage paid. The returned goods may show no use traces. We then refund you the costs of the return together with the purchase price. We do not refund costs for dispatch carriers, express items and all other modes of transport which go beyond the normal mail-order. Returns that are not postage paid by you in principle are not accepted by us but immediately decline to the consigner. At a deterioration of the product(s) equivalent compensation can be required. This is not valid if the deterioration of the product(s) can be explained by the examination exclusively as it would have been possible in the retail shop for you.

Please take into account that a delivery refusal is not a return under remote sales act. In this case the customer is liable for the damage we have resulting from it. This is agreed on flatly with 10% of the net invoice amount plus value added tax. Furthermore the customer has to bear the costs for to and return transport as well as a handling fee of 5. EUR. If the not buyer can prove a lower damage against the seller, so only this has to be settled.

We reserve for us to close customers of further supplyings, if either they have high order values and/or several orders delivered only for view purposes of us to themselves.

3. Supply contents, order values and transportation costs
All net4moto offers are without engagement and we reserve errors for us. The lowest order value is 40,00 EUR. The product remains until fully paid property of net4moto Ulf Lohberg. Please send us no cash and no cheques. We cannot assume any liability namely at loss for this.
The delivery of your order through us is carried out under the reservation that we are supplied correctly and on time ourselves and do not have to represent the missing availability of the product. Compensation also on a delayed or incomplete delivery is excluded as far as there is no gross negligence. At non-availability of the product we will inform you as quickly as possible. Differences can appear in colour, form, material and decoration at the delivered products. We reserve the right to partial delivery at supply bottlenecks for some articles. Regarding material defects or guarantee cases appearing perhaps at articles the German legal regulations are valid.
Your dispatch cost sharing for deliveries to foreign countries calculates itself from the costs actually arising. These are based on the weight of your ordered goods as well as the packaging weight. Through this the arising postage and freight charges as well as the costs for packing are for the most part covered. You can gather the detailed transportation costs based on weight and delivery country from our transportation costs tables under the menu item "transportation costs and delivery countries". Your dispatch cost sharing for deliveries within Germany are 6,85 EUR overall up to 31 kg.
You pay the dispatch cost sharing per order only once. Also then if we should deliver for technical reasons in several shipments. Please take into account that at exchange in other sizes or other articles your dispatch cost sharing arises once more. By the way: As of 200,00 EUR order value, we take on completely the transportation costs for orders which are dealt with within Germany.

4. Modes of payment
In principle, the articles ordered by you are delivered to you with the mode of payment with which you have ordered (payment in advance, invoice, cash on delivery or credit card). We must reserve at orders on invoice or by credit card according to the respective credit standing to carry out the delivery perhaps only against cash on delivery to the protection against our credit risk. For cash on delivery orders we charge you the COD charge of EUR 6.30, (incl. a legal vat).
If you are a net4moto regular customer we deliver your order against invoice up to the value of 350,00 EUR. You become a net4moto regular customer if you have registered with your personal data at us and you have already ordered at least once, paid and not returned the order itself. net4moto regular customers have to be domiciled in Germany.
The prices mentioned on the Internet include the legal value added tax (for domestic as well as EU customers). If you have applied and logged in in the Internet Shop as a not EU foreign customer, the prices which you then are billed for are without value added tax, as well as the shop prices shown to you are without value added tax.

5. Other
The data necessary for the business processing are saved under compliance with the regulations of the Federal Data Protection Law and passed on to connected enterprises if necessary in the context of the order handling. All personal data are dealt with of course confidentially. To an end of the loan appraisal we exchange data with other mail order enterprises and if necessary with German Schufa.
Place of performance and place of jurisdiction are - in this respect legally permitted - Kaarst.
